1. Acceptance
Welcome to WorkMark Camera (the "App"). These terms form an agreement between you and the operator of the App regarding your use of it, and apply to the iOS version of the App (iPhone and iPad). Please read them carefully. By registering, signing in or otherwise using the App, you accept these terms in full. If you do not accept them, please stop using the App.
2. Accounts
You can sign in with Google, with Apple or with an email address. The details you provide must be true and accurate, and you are responsible for keeping your account and credentials safe. You bear the consequences of a compromised account or leaked information caused by your own failure to safeguard them. You may not transfer, lend or otherwise give your account to anyone else.
3. What the service does
The App provides photo and video capture, watermark compositing, place and weather stamps, tamper verification, watermark and logo management, and shot syncing, all free of charge; paid services are covered in section 6. We may adjust, add to or improve these features as the business requires, and will notify you appropriately.
4. Acceptable use
You must comply with the law and with public decency. You may not use the App to:
1. Publish or distribute unlawful content, content that infringes others' rights, or content contrary to public order and morals;
2. Forge or alter watermark information for fraud or any other improper purpose;
3. Infringe anyone's intellectual property, likeness or privacy rights;
4. Interfere with or damage the App's operation, or attack our servers or network;
5. Do anything else that breaks the law or these terms.
You are responsible for the consequences of breaching the above.
5. Intellectual property
Unless agreed otherwise, the intellectual property in the App and in its interface, icons, templates, text and graphics belongs to the operator or the relevant rights holders. Content you shoot or upload remains yours; to provide the service you grant us the right to store and process that content to the extent reasonably necessary.
6. Paid services and auto-renewal
The App offers a paid membership in three plans — Monthly, Quarterly and Yearly — all of them auto-renewing subscriptions. While your membership is active you can use the members-only features; the exact benefits are those set out in the Membership Agreement and actually provided in the App.
1. Purchase and payment — membership is bought through Apple In-App Purchase and charged to your Apple account when you confirm; prices are those shown on the purchase page and the App Store checkout page. The App never receives your card or bank details;
2. Auto-renewal — unless you turn off auto-renewal at least 24 hours before the current period ends, the subscription renews automatically and Apple charges your account at the plan price within the 24 hours before the period ends;
3. Managing and cancelling — you can turn off auto-renewal at any time in Settings > Apple ID > Subscriptions on your iPhone. Your benefits for the current period are unaffected, and nothing further is charged after it ends;
4. Refunds — Apple collects membership payments and refunds follow Apple's rules; request one at reportaproblem.apple.com.
The Membership Agreement sets out the details of benefits, billing, renewal, cancellation and refunds; please read it before you buy. If we add any other paid service, we will publish its pricing before you buy, and whether to buy is up to you.
7. Disclaimer
To the extent permitted by law, the App is provided "as is". We are not liable for interruptions or data loss caused by matters outside our control — force majeure, network failures, third-party outages or device problems — though we will do what we can to help. The time, place and weather shown in a watermark depend on your device and on third-party services, may be inaccurate, and are provided for reference only.
8. Changes, suspension and termination
We may change, suspend or end part or all of the service because of business changes, maintenance or legal requirements, and will give appropriate advance notice. If you breach these terms we may suspend or end your access.
9. Changes to these terms
We may revise these terms and will publish the revision in the App. Revised terms take effect when published. Continuing to use the App after that means you accept them.
10. Governing law and disputes
These terms are governed by the laws of the People's Republic of China. Disputes arising from these terms or from the service should first be settled amicably; failing that, either party may bring proceedings in a court of competent jurisdiction.
